Welcome to Build Kingdom. These Terms of Service ("Terms") govern your use of our website and the purchase of construction materials, including but not limited to cement, steel, sand, and bricks. By accessing our site or placing an order, you agree to be bound by these Terms.

1. Product Information and Pricing

Descriptions: We strive for maximum accuracy in describing materials (e.g., cement grades, steel dimensions). However, minor variations in color or texture (especially in natural materials like sand and bricks) are common and shall not be deemed as defects.
Pricing: Prices for construction materials are volatile and subject to market fluctuations. We reserve the right to change prices at any time without notice. The price applicable is the one displayed at the time of final checkout.
Taxes: All prices are [Inclusive/Exclusive] of GST and other applicable taxes unless stated otherwise.

2. Orders and Cancellations

Order Acceptance: Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to decline any order for reasons including stock unavailability or delivery constraints.
Cancellations: Orders for materials like Ready-Mix Concrete (RMC) or customized steel cutting cannot be cancelled once processing has begun. For standard bagged cement or bricks, cancellations must be made within [Insert Hours] of order placement.

3. Shipping and Delivery Conditions

Due to the heavy nature of construction materials, specific delivery rules apply:

Site Accessibility: It is the customer’s responsibility to ensure that the delivery site is accessible by heavy heavy-duty trucks. If a vehicle cannot enter the site due to narrow roads or obstacles, the customer will bear the cost of re-delivery or manual unloading.
Unloading: Unless "Unloading Services" are explicitly purchased, the customer is responsible for providing labor for unloading materials from the vehicle.
Delivery Timelines: While we aim for punctuality, delivery times are estimates. We are not liable for labor costs or project delays caused by late deliveries due to traffic, weather, or vehicle breakdowns.

4. Quality and Acceptance

Inspection: Customers must inspect the materials immediately upon delivery. Any shortage in quantity (e.g., bag count or brick units) or visible damage must be noted on the Delivery Challan before the driver leaves.
Weight Discrepancy: For bulk materials like sand or aggregate, a weight variation of [e.g., 2-5%] is considered acceptable due to moisture content and transit handling.
Cement Freshness: We guarantee that cement is within its manufacturer-recommended shelf life at the time of delivery.

5. Returns and Refunds

Non-Returnable Items: Due to perishability and storage risks, cement bags cannot be returned once they have been stored at a customer's site.
Steel & Bricks: Returns for steel and bricks are accepted only if they do not meet the specified grade or dimensions, provided they are in the same condition as delivered.
Restocking Fee: A restocking fee may apply to approved returns.

6. Limitation of Liability

Build Kingdom shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, structural failures due to improper material application, or project delays. Our maximum liability is limited to the purchase price of the specific product in question.

7. Proper Storage and Usage

The customer is responsible for the proper storage of materials (e.g., keeping cement away from moisture). We are not responsible for the deterioration of material quality due to improper on-site storage or incorrect usage by the customer’s contractors.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Karnataka. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore.
